These Terms of Use ("Terms") govern your access to and use of the ServerMetry server monitoring platform ("Service"), operated by FloBa Media ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.
1. The Service
ServerMetry provides infrastructure monitoring, alerting, notifications, and related tools. Features and limits may depend on your subscription plan. We may update the Service from time to time.
2. Accounts and organizations
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and promptly update it if it changes. Organization owners and admins are responsible for invitations, member access, and compliance within their workspace.
3. Acceptable use
You agree not to:
- use the Service in violation of applicable law;
- probe, scan, or test the vulnerability of systems without authorization;
- interfere with or disrupt the Service or its infrastructure;
- upload malicious code or attempt unauthorized access to other accounts or data;
- resell or sublicense the Service except as expressly permitted by us.
4. Agents and monitored systems
Installing the ServerMetry agent on a server requires appropriate rights on that system. You are solely responsible for configuring agents, API keys, firewall rules, and data collection scope. You represent that you have permission to monitor every system you connect to the Service.
5. Data and privacy
Our processing of personal data is described in our Privacy Policy. You retain ownership of your monitoring data. You grant us the rights necessary to host, process, and display that data solely to provide and improve the Service.
6. Subscriptions and billing
Paid plans are billed according to the pricing shown at checkout or in your dashboard. Fees are non-refundable except where required by law. We may change prices with reasonable notice. Failure to pay may result in suspension or downgrade of your account.
7. Availability and support
We strive for high availability but do not guarantee uninterrupted or error-free operation. Maintenance windows, third-party outages, and force majeure events may affect the Service. Support scope depends on your plan.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOBA MEDIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if continued provision becomes impractical. Upon termination, your right to use the Service ends; certain provisions survive, including limitations of liability.
11. Changes
We may update these Terms. Material changes will be communicated via the Service or email. Continued use after changes become effective constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of Germany, without regard to conflict-of-law principles. Mandatory consumer protection laws in your country of residence remain unaffected where applicable.
